I can’t affort to get a proper provider for hosting freeware stuff. No music in the game since nobody of the C64 sceners is willing to compose some for me! (and yes I asked {several times}). I released C64 version cause I saw it as a easy port from the Apple 2 versions. And I complained since seemed that I by accident meet some ’no-nice’ C64 users. @130 I saw ’ISDA’ closing site with freeware puckman clones, and I made so many ’commercial’ games clones (King Kong, BoxWorld, simple Oric puckman, BreakOric etc... Not to mention the AntiISDA warrior), so it’s just a matter of time till they find the site and close it and I don’t want anybody else to take the trouble instead of me. By using the free hosts although with low quality keeps me more mobile. If they delete the site - that’s ok. I will register somewhere else and host it there. If I use paid service - the money might went to nowhere.

drHirudo, at #c-64 you were kicked by an idividual person, so blame that person. At #c-64 there are too many people caring about what is good and what is not for #c-64. You are not the only person who has to live with that. Anyway, the best place to ask musicians for help, is to register in the C64 scene database (by releasing C64 productions you practically became a c64 scener) and ask people there, in the forums.

Maybe those freeware Pac-Man clones blatantly had stolen the graphics from the coin-op Pac-Man, so it was a partitial copyright infringement? To my knowledge, there are no patents on Donkey Kong, Break-Out, Q*Bert, Defender etc, so The ESA (as they are called these days)probably can’t operate on behalf of patent holders if they threaten hosts to take down pages. In most of the cases the threat seems to be signed by a non-existing person too, because if you answer the message almost never you get a response (I’ve heard). But yes, if you can get hosting somewhere else which doesn’t throw ten popups and a spyware installer whenever you visit your page, that can only be good news.

Well, didn’t Back to Roots deal with (previously) commercial Amiga stuff, or did they only host free remakes of ditto? In many cases, it is true that former IDSA and BSA attack randomly - remember the request to remove games from WoS which they had written permit to host or the threat to a German university to remove the OpenOffice mirror, as it infringed Microsoft. Of course, if you mix your own stuff with other titles of uncertain distribution status, you should be careful.

@130 I saw ?ISDA? closing site with freeware puckman clones, and I made so many ?commercial? games clones (King Kong, BoxWorld, simple Oric puckman, BreakOric etc... Not to mention the AntiISDA warrior), so it?s just a matter of time till they find the site and close it and I don?t want anybody else to take the trouble instead of me. By using the free hosts although with low quality keeps me more mobile. If they delete the site - that?s ok. I will register somewhere else and host it there. If I use paid service - the money might went to nowhere.

I think those IDSA people are complete and utter sods. May they die in vain!

They’re called the ESA this week... from what i understand, a fair few of the shutdown notices were due to their spidering the sites in question and picking up on names of zipfiles - for example, quake.zip might actually be Mike Singleton’s Quake Minus One.

However, ESA has one good purpose - to hunt down permits to distribute old software, preferrably as untouched as possible. Sites who do so (WoS, Lemon64 etc) can display these written permits to anyone who claims to represent the copyright holders. Sure, not all software houses will allow distribution - we already know Codemasters, Electronic Arts, Capcom, Rare etc (not to mention Sega, Sony and Nintendo) will deny with a good reason, but several of the others, both folded, still alive and possibly even actively developing will allow under certain limitations. This is however a time-consuming job to track people down and wait for responses.

[142]: Does it somehow change the copyright status if the scene (whoever that is, juridically) claims it was brought up on piracy (but now is feeding itself with own productions and a few jokers releasing other people’s work for good old times sake)? Maybe ESA wouldn’t care if there were no emulators or transfer tools, because then the software wouldn’t spread easily.

(so, it is people like the VICE team and X1541 Shop who in the end are responsible for dr Hirudo’s site being brought down ;-)

No, the emulators are not responsible for the games spreading. I had some MAME games long before they were added to the emulator list. What makes me sick of IDSA is that they ruined sites like FUNET and Magyar C64HK, but pirate servers with TOSEC sets like PEmu stay online for years. There are too many places where you can find software (binary newsgroups, IRC, web, FTPs) and assuming that you are not a lamer, you can easily find and leech everything. But while this is bad for the software developers, it’s good for the CDRW and DVDRW producers ;) And this killed the swapping business and I am ex-swapper now.

Pardon me, but without people swapping, what good would the scene be? producing demos never to be spread? Cool idea...Machines to me is about the way of obtaining software to use, else its just another box in the collection. C64 was divine in this case...really...now kill me!

In the case of Funet, it is a state financed university network, so I understand why Marko decided to take offline (not remove) all titles which were not clear to be published. Anyone independent with the means to host a such FTP could take over, and there are some partitial mirrors. Of course it is easier to shoot at a sitting bird than one fleeing. Anyone with the nerves can take the titles offline, question the ESA letter (but probably never receive a response) and later put it back up again waiting for another threat.
